Terms of Service
The agreement between you and TrackSpace - what you get, what we promise, and what we do not.

TrackSpace is a tool for tracking what you run, what wears out on it, and how you drove. These terms are the agreement between you and TrackSpace LLC ("TrackSpace", "we", "us") covering the TrackSpace web application and its API. By creating an account or using the service, you accept them. If you do not accept them, do not use the service.
We have tried to write these in the same plain language as our Privacy policy, which covers what we do with your data and forms part of this agreement.
1. Your account
You need an account to use TrackSpace. You sign in through an identity provider — Google, Apple, or Microsoft — or with an email address. We never see or store your password.
You must be at least 18 years old. You are responsible for what happens under your account, including anything done by drivers you add to it, and for keeping your sign-in method secure. Tell us at trackspace.support@outlook.com if you believe someone else has access to it.
One person, one account. Do not share sign-in credentials with people outside your membership's driver allowance.
2. Memberships
TrackSpace is sold as memberships — Paddock, Grid, Podium and Pole Position. What each one includes is shown on your Account page and on the signup page, and those pages are the current statement of what you get. Paddock is free permanently. The others carry a monthly or annual price.
Limits are enforced, not advisory. If you hold more cars, tracks or drivers than your membership allows — usually because you moved down a tier — the excess becomes read-only rather than deleted. Your data stays yours and stays intact; you simply cannot add to it until you are back within the limit.
3. Prices, billing and taxes
Prices are shown in US dollars on the Account page and at checkout. Annual billing is discounted against the monthly rate, and the discount is shown before you commit.
Paid memberships renew automatically at the end of each period until you cancel. We charge the payment method on file. If a charge fails we may retry it, and may suspend paid features until it succeeds.
US sales tax is calculated at checkout and is not included in the prices shown. You are responsible for any other taxes that apply where you are.
We may change prices. If we do, we will tell you at least 30 days before the change affects you, and you can cancel before it takes effect.
4. The introductory period
TrackSpace is currently in an introductory period. During it, every membership tier is free, and you can use any of them without giving us a card or any other payment detail. There is no trial that quietly converts, because there is nothing on file to convert.
The introductory period does not have a fixed end date. When we decide to end it:
- We will tell you at least 30 days beforehand.
- We will not charge you anything unless you actively agree to start paying — by choosing a membership and entering a payment method. Silence is not consent, and we will not treat an account created during the introductory period as having agreed to a future charge.
- If you do nothing, your account moves to Paddock, the free tier, under the read-only rule in section 2. You lose access to paid features. You do not lose your data.
5. Changing or cancelling
You can move up or down a tier, switch between monthly and annual billing, or cancel at any time from your Account page.
Moving up takes effect immediately and we prorate the remainder of the current period. Moving down or cancelling takes effect at the end of the period you have already paid for — you keep what you paid for until then. We do not refund partial periods, except where the law where you live requires it.
You can export your data at any time, and you can delete your account, which deletes your data. See the Privacy policy for what that covers.
6. Your data
Your records are yours. Cars, tracks, sessions, setups, service history, notes, laps, photos — you own them and you keep them.
You give us only the permission we need to run the service for you: to store your records, process them to produce the things the app computes (wear, pace, recaps, plans), display them back to you, and share them with people you explicitly share them with. That permission ends when you delete the content or your account.
We do not sell your data. We do not use your records to advertise to you. We may use aggregated, de-identified information — which cannot be traced back to you or your vehicles — to understand how the service is used and to improve it.
7. Sharing
Some features let you share your records — with friends, with people at an event, or through a link. When you use them, you are instructing us to disclose that data, and you are responsible for what you share and who you share it with.
Anyone you share with is bound by these terms for what they do with what they receive. A share link can be forwarded by whoever holds it; treat a link as public.
8. Acceptable use
Do not: break the law with it; upload someone else's data without their permission; try to access another user's account or data; probe, scrape, overload or reverse-engineer the service; resell access; or use it to harass anyone.
The API exists to serve the app. Automated access outside the app — bulk scraping, mirroring, or building a competing service on our data — is not permitted without our written agreement.
9. Services we rely on
TrackSpace depends on services we do not control, including our identity provider, our payment processor, mapping and geocoding, and weather data. Their availability and behaviour is not something we can guarantee. The Privacy policy names who they are and what reaches them.
10. Safety, and what TrackSpace is not
This section matters more than the rest of them.
TrackSpace is a record-keeping tool. It tracks what you told it, and it computes from what you told it. It is not an inspection, an engineering assessment, or a safety system.
In particular:
- Wear tracking, service intervals and "remaining life" figures are estimates derived from the numbers you enter. They are only as good as your inputs, and they know nothing about the actual physical condition of any component. A brake pad that TrackSpace shows as having life left can still be unsafe.
- Never use TrackSpace in place of physically inspecting your vehicle, following the manufacturer's guidance, or the judgement of a qualified technician. If the app and the part disagree, the part is right.
- Setup data, plans, goals, coaching notes and pace analysis are informational. How you drive, what you run, and whether you go out are your decisions and your responsibility.
- Motorsport and track driving are dangerous. You take part at your own risk, and nothing in this service reduces that risk or implies that we have assessed it.
You are responsible for the roadworthiness and race-worthiness of your vehicles, and for complying with the rules of any event you attend.
11. Availability and changes
We aim to keep TrackSpace running, but we do not promise uninterrupted availability. We may change, add or remove features. Where a change materially reduces what a paid membership includes, we will tell you before it takes effect and you can cancel.
Features marked as preview, draft, or otherwise unfinished may change or disappear, and we make no promises about them.
12. Ending it
You can stop using TrackSpace and delete your account at any time.
We may suspend or close your account if you materially breach these terms, if we are required to by law, or if your use puts the service or other users at risk. Except where the breach is serious or we are legally obliged to act immediately, we will tell you first and give you a chance to put it right. If we close your account other than for a breach by you, we will refund the unused part of any period you have paid for.
If your account is closed you can export your data first, and we will handle what remains as the Privacy policy describes.
13. Disclaimers
TrackSpace is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted or error-free, or that anything it computes is accurate. See section 10.
Some jurisdictions do not allow these exclusions, in which case they do not apply to you.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, damage to a vehicle or its components, personal injury, or death, arising out of your use of TrackSpace.
Our total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose.
Nothing here limits liability that cannot be limited by law — including, in many jurisdictions, liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
You will indemnify us against claims, losses and costs arising from your breach of these terms, your misuse of the service, or data you upload that you did not have the right to upload.
16. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
Arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Texas or conducted remotely at your election. Judgment on the award may be entered in any court with jurisdiction.
Class-action waiver. Disputes will be brought only in your individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. Arbitrations will not be consolidated. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to the others.
What is not covered. Either of us may bring an individual claim in small-claims court instead, and either of us may seek injunctive relief in court to protect intellectual property or stop unauthorised access to the service.
Informal resolution first. Before starting arbitration, write to us at trackspace.support@outlook.com describing the dispute and what you want. Give us 30 days to try to settle it.
If you are a consumer, none of this deprives you of the protection of mandatory laws where you live, or of any right to bring proceedings that those laws do not allow you to waive.
17. Changes to these terms
We may update these terms. If a change is material, we will update the date at the top of this page and tell you in the app before it takes effect. Continuing to use TrackSpace after that means you accept the updated terms. If you do not, cancel and delete your account.
